Acceptable Usage Policy
1. Introduction
This Acceptable Usage Policy (“Policy”) governs your use of Rootscope’s hosting services, including all associated hardware, software, networking, and storage components (“Services”). By using our Services, you agree to comply with this Policy. Because Internet usage standards continuously evolve, we reserve the right to modify this Policy at any time. We will notify you of material changes via email and/or through our customer portal at least 30 days before they take effect. If such changes materially and adversely affect your ability to use the Services, you may terminate your Agreement without incurring additional fees by providing written notice within 30 days of receiving notification of the changes.
You are responsible for ensuring that your end users comply with this Policy. You agree to incorporate these requirements, or restrictions no less protective of our interests, into your agreements with end users.
2. Prohibited Activities
2.1 Legal Compliance
You may not use the Services to violate any applicable laws or regulations, including but not limited to:
- Copyright, patent, trademark, or trade secret infringement
- Data protection and privacy laws
- Export control laws and international sanctions
- Anti-gambling laws and regulations
- Financial services and securities regulations
- Consumer protection laws
2.2 Harmful Content
The Services may not be used to store, distribute, or transmit:
- Child exploitation material of any kind
- Non-consensual intimate content
- Content promoting terrorism or extremist ideologies
- Materials related to human trafficking
- Content that incites or threatens violence
- Hate speech or discriminatory content
- Defamatory material or content violating privacy rights
- Malicious software or unauthorized hacking tools
- Content that infringes on intellectual property rights
- Content related to illegal weapons trafficking
2.3 Network and System Integrity
You must not engage in activities that:
- Target our systems or networks with denial of service attacks
- Attempt to gain unauthorized access to other networks or systems
- Interfere with other customers’ use of the Services
- Circumvent any security measures we have implemented
3. Email and Messaging
3.1 Spam Prevention
All email communications must comply with the CAN-SPAM Act and similar international regulations. Specifically:
- Maintain accurate header and routing information
- Use clear subject lines that don’t mislead recipients
- Include a valid physical address
- Provide clear opt-out mechanisms
- Honor opt-out requests within 10 business days
- Maintain clean email lists with valid opt-in records
3.2 Technical Restrictions
- Maximum outbound messages: 500 per hour per account
- Maximum recipients per message: 100
- Maximum concurrent SMTP connections: 20
- Bounce rate must remain below 5%
3.3 Penalties
Spam violations incur a fee of $500/€450/£400 per incident. This fee represents a reasonable estimate of damages and is not intended as a penalty.
4. Resource Usage
4.1 System Resources
- Usage exceeding 200% of average customer consumption may trigger a review
4.2 Data Transfer
- Usage exceeding 200% of average customer consumption may trigger a review
4.3 Service Limitations
The following services are prohibited:
- Open proxies
- Internet Relay Chat (IRC) servers
- Continuous video streaming services
- Cryptocurrency mining
- BitTorrent trackers
- Public file-sharing services
5. Security Requirements
5.1 Customer Responsibilities
- Maintain secure passwords and access credentials
- Promptly apply security patches and updates
- Monitor for and report suspicious activities
- Implement reasonable security measures for applications
5.2 Incident Reporting
Report security incidents within 24 hours to [email protected]
6. Enforcement
6.1 Monitoring and Investigation
We reserve the right to:
- Monitor compliance with this Policy
- Investigate suspected violations
- Take appropriate enforcement action
- Cooperate with law enforcement when required
6.2 Enforcement Actions
Violations may result in:
- Immediate suspension or termination of Services
- Removal of prohibited content
- Financial penalties as specified in this Policy
- Legal action if necessary

7. General Provisions
7.1 Governing Law
This Policy is governed by the English law or the laws of the Client’s country of domicile or any other place where the results of such purpose or the material in question are likely to be accessed without regard to conflicts of law principles.
7.2 Severability
If any provision of this Policy is found to be unenforceable, the remaining provisions will remain in full force and effect.
